Welcome to Next Level Structural Landscaping. These Terms of Service (“Terms”) constitute a legally binding agreement between you (“Client,” “you,” or “your”) and Next Level Structural Landscaping (“Company,” “we,” “us,” or “our”).
By accessing our website, using our services, or entering into an agreement with us, you accept these Terms in full. If you do not agree with any part of these Terms, please refrain from using our services.
1. Services Overview
Next Level Structural Landscaping offers landscaping, fencing, and related outdoor services, including:
- Timber Fencing
- Colorbond Fencing
- Cool Fencing
- Glass Fencing
- Concrete Retaining Walls
- Timber Retaining Walls
- Earthworks
- Drainage Design
Our services are provided based on the project scope agreed upon with the client. Any additional services outside the agreed scope must be requested and may incur extra charges.
2. Eligibility for Service
You must meet the following criteria to use our services:
- Be at least 18 years old and legally capable of entering into a contract.
- Own or have legal authority over the property where services will be rendered.
3. Quotations and Estimates
- All quotes are valid for 30 days from the date of issuance unless otherwise specified.
- Estimates provided are based on the information available at the time of consultation. Final costs may vary due to unforeseen circumstances or changes in the project scope.
- Any changes to the agreed project plan must be documented in writing and may result in additional costs.
4. Payment Terms
- A deposit of 20-30% is required to secure your booking. The deposit amount will be outlined in your quote or contract.
- Full payment is due upon project completion unless otherwise agreed in writing.
- Late payments may incur a 3% monthly interest fee.
- Accepted payment methods include bank transfers, credit/debit cards, or other agreed-upon methods.
Failure to pay for services as agreed may result in suspension of services, legal action, and/or additional collection fees.
5. Project Timeline
- We will provide an estimated project timeline; however, actual timelines may be affected by weather, material availability, or other unforeseen circumstances.
- Any delays caused by the client, including lack of access to the property, may result in rescheduling and additional fees.
6. Client Responsibilities
- Property Access: You must provide us with safe and unrestricted access to the property during the project.
- Permits and Approvals: You are responsible for obtaining all necessary permits, approvals, and consents unless otherwise agreed upon in writing.
- Site Preparation: The project site must be clear of obstructions, including pets, vehicles, and personal belongings, before work begins.
- Utility Information: You must disclose any underground utilities, pipelines, or hazards on the property to avoid accidental damage.
7. Materials and Warranty
- We use high-quality materials that meet industry standards. However, warranties on materials are provided by their respective manufacturers.
- Workmanship is warranted for 12 months from the project completion date.
- Warranty claims will not be honored if damage is caused by:
- Neglect or misuse of the installed structures.
- Alterations made by the client or third parties without our consent.
- Extreme weather conditions, acts of God, or other unforeseen events.
8. Cancellations and Refunds
- Client-Initiated Cancellations:
- Deposits are non-refundable unless otherwise agreed upon in writing.
- Cancellation after 2 Days of the scheduled start date may result in additional fees to cover preparatory costs.
- Company-Initiated Cancellations:
- If we cancel a project due to circumstances beyond our control, we will provide a full refund of any payments made.
9. Liability and Indemnity
- Limitation of Liability:
- We are not liable for any indirect, incidental, or consequential damages arising from our services.
- Our liability is limited to the amount paid for the specific service provided.
- Indemnification:
- You agree to indemnify and hold us harmless from any claims, damages, or liabilities arising from your breach of these Terms, negligence, or misuse of our services.
10. Force Majeure
We are not responsible for delays or failures to perform caused by circumstances beyond our reasonable control, including but not limited to natural disasters, labor strikes, material shortages, or government actions.
11. Dispute Resolution
- Amicable Resolution: We strive to resolve disputes amicably through open communication.
- Mediation/Arbitration: If a resolution cannot be reached, disputes will be referred to mediation or arbitration in Brisbane, Queensland, Australia.
- Legal Action: If legal action is required, it must be filed in the courts of Queensland, Australia.
12. Termination of Services
- By the Client: You may terminate services at any time by providing written notice. Any costs incurred up to the termination date will remain due.
- By the Company: We reserve the right to terminate services for non-payment, unsafe working conditions, or breach of these Terms.
13. Privacy and Confidentiality
Your personal information is protected under our Privacy Policy. We will not share your information with third parties without your consent, except as required by law.
14. Intellectual Property
All designs, plans, and documentation provided by us remain our intellectual property unless otherwise agreed in writing. You are not permitted to use, copy, or reproduce our materials without prior approval.
15. Changes to Terms
We reserve the right to update or modify these Terms at any time. Changes will be effective upon posting on our website. It is your responsibility to review these Terms periodically.
16. Entire Agreement
These Terms, along with any written agreements or invoices, constitute the entire agreement between you and Next Level Structural Landscaping. They supersede any prior agreements or understandings.
